1. Parties and Acceptance

This agreement is between you, the individual accessing or using mybiochecks.com, and mybiochecks, the owner and sole operator of mybiochecks.com. By creating an account, logging in, or using any feature of this app in any way, you agree to every term stated on this page in full, without exception. If you do not agree to every term, you must stop using the app immediately and permanently delete your account. There is no partial acceptance of these Terms.

2. What This App Is

mybiochecks.com is an educational web application. Its entire purpose is to display general educational information about common biometric screening values that you manually enter. Specifically it does the following and nothing more:

• Accepts biometric numbers that you type in manually
• Displays general reference range information for those values
• Uses an AI system to generate plain English educational text about those values
• Saves your entered data to allow you to review it over time

3. What This App Is Not

mybiochecks.com is not, under any circumstances, any of the following:

• A medical device of any kind
• A licensed healthcare service
• A clinical diagnostic tool
• A treatment planning tool
• A prescription or medication guidance tool
• A substitute for seeing a licensed physician, nurse practitioner, physician assistant, or any other licensed healthcare provider
• A HIPAA-covered entity or business associate
• Approved, reviewed, cleared, or endorsed by the FDA, any state medical board, the CDC, the AHA, or any other governmental or medical authority
• A service that establishes a doctor-patient relationship of any kind
• A service that creates any professional or fiduciary relationship between you and mybiochecks or anyone associated with mybiochecks

4. No Medical Advice

Nothing on this app, including but not limited to text, AI-generated responses, color-coded indicators, range bars, tips, recommendations, summaries, trend data, or any other content, constitutes medical advice. Nothing on this app should be interpreted as a diagnosis of any medical condition. Nothing on this app should be interpreted as a recommendation to start, stop, or change any medication, treatment, diet, or healthcare plan. You must not act on information from this app without first consulting a licensed healthcare provider who knows your full medical history.

5. AI-Generated Content Limitations

The explanations, summaries, and chat responses in this app are generated entirely by an artificial intelligence system. You must understand and accept all of the following before using this app:

• AI-generated content can be and sometimes is factually incorrect
• AI-generated content can be outdated
• AI does not know your full medical history, current or past medications, allergies, prior diagnoses, or any other personal health factors beyond what you have entered into the app in that session
• AI-generated content is not reviewed, verified, or approved by any licensed medical professional before it is shown to you
• The same AI response may be completely inappropriate for two different people who have entered the same biometric values
• AI systems can produce confident-sounding responses that are medically wrong

Under no circumstances should AI-generated content from this app be treated as medical advice, diagnosis, or treatment guidance.

6. Reference Ranges Are General Guidelines Only

The reference ranges displayed in this app are general population guidelines sourced from publicly available medical literature. They are not personalized to you. Reference ranges vary based on the specific laboratory that performed your test, the testing methodology used, your age, your biological sex, your current medications, your medical history, your ethnicity, and other individual factors. The reference ranges shown in this app will not always match the reference ranges on your actual lab report. When a discrepancy exists, your official lab report takes priority. You must discuss your actual lab results with the healthcare provider who ordered the test.

7. Assumption of Risk

You expressly acknowledge that you understand the limitations of this app as described in these Terms. You voluntarily choose to use this app knowing those limitations. You assume full and complete responsibility for any action you take, any decision you make, and any outcome that results from your use of this app. mybiochecks does not assume any responsibility for consequences of your use of this app.

8. Complete Limitation of Liability

To the maximum extent permitted by applicable law, mybiochecks, its owner, developers, contractors, agents, and any affiliated parties are not liable for any of the following, regardless of how they arise:

• Any health outcome, including injury, illness, worsening of a medical condition, or death
• Any decision you made based on information from this app
• Any delay in seeking medical care because you used this app
• Any incorrect, incomplete, or misleading information displayed by this app
• Any failure of the AI system to produce accurate information
• Any unauthorized access to your account or data
• Any loss of data due to technical failure
• Any interruption or unavailability of the service
• Any direct, indirect, incidental, special, consequential, punitive, or exemplary damages
• Any financial losses resulting from your use of this app
• Any emotional distress resulting from your use of this app

This limitation of liability applies even if mybiochecks was informed of the possibility of such damages. This limitation applies under all legal theories including negligence, breach of contract, tort, strict liability, and any other theory.

9. Indemnification

You agree to fully indemnify, defend, and hold harmless mybiochecks and its owner, officers, employees, agents, contractors, and successors from any and all claims, lawsuits, demands, liabilities, damages, judgments, settlements, losses, costs, and expenses, including reasonable attorney fees and court costs, that arise from or relate to any of the following:

• Your use of this app
• Your violation of any provision of these Terms
• Any decision you made based on content from this app
• Any harm to yourself or any other person resulting from your use of this app
• Any false or inaccurate information you submitted through this app
• Your violation of any applicable law or regulation
• Your infringement of any third-party right

10. No Warranties of Any Kind

This app is provided as-is and as-available with no warranties of any kind, express or implied. mybiochecks expressly disclaims all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, completeness, and non-infringement. We do not warrant that this app will be available at all times, free from errors, free from security vulnerabilities, or that any defects will be corrected. We do not warrant that the information provided through this app is medically accurate, current, or appropriate for any individual user.

11. User Account Responsibilities

You are solely responsible for the following:

• Keeping your account credentials confidential
• All activity that occurs under your account whether or not you authorized it
• The accuracy of all data you enter into the app
• Notifying mybiochecks immediately if you become aware of unauthorized access to your account
• Ensuring that your use of the app complies with all applicable laws

You may not create an account on behalf of another person without their explicit consent. You may not share your account credentials with any other person. You may not create more than one account per person.

12. Prohibited Uses

You are expressly prohibited from using this app to do any of the following:

• Provide medical advice, diagnoses, or treatment recommendations to any other person
• Engage in any activity that violates federal, state, or local laws or regulations
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of this app
• Transmit any harmful, threatening, abusive, defamatory, or otherwise objectionable content
• Collect, scrape, or harvest data from this app without written permission
• Use automated bots, scripts, or tools to access or interact with this app
• Attempt to gain unauthorized access to any part of this app or its underlying systems
• Interfere with the proper functioning of this app
• Impersonate any person or entity
• Use this app for any commercial purpose without written permission from mybiochecks
• Upload or submit false, misleading, or fraudulent information

13. Third-Party Services

This app uses third-party services to operate. These services are Google Firebase for authentication and data storage, Anthropic for AI-generated content, and Netlify for web hosting. By using this app, you also agree to be bound by the terms and privacy policies of each of these third-party services. mybiochecks is not responsible for the practices, policies, security, or availability of any third-party service. If a third-party service experiences a breach, outage, or change in policy that affects your data or your use of this app, mybiochecks is not liable for any resulting harm.

14. Intellectual Property

All content, code, design, graphics, logos, text, features, and functionality of mybiochecks.com are the exclusive property of mybiochecks and are protected by copyright, trademark, trade secret, and other applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use this app solely for your personal, non-commercial use as described in these Terms. You may not copy, reproduce, modify, distribute, sell, license, publicly display, publicly perform, or create derivative works from any part of this app without prior written permission from mybiochecks.

15. Termination

mybiochecks reserves the right to suspend or permanently terminate your account and your access to this app at any time, for any reason, with or without notice. Reasons for termination include but are not limited to violation of these Terms, conduct that mybiochecks determines to be harmful to other users or to the operation of the app, and extended periods of inactivity. Upon termination, your right to use the app ceases immediately. All provisions of these Terms that by their nature should survive termination, including Sections 4, 7, 8, 9, 10, and 14, will survive termination.

16. Right to Modify or Discontinue

mybiochecks reserves the right to modify, suspend, or permanently discontinue this app or any part of it at any time, with or without notice to you. mybiochecks is not liable to you or any third party for any modification, suspension, or discontinuation of the app. mybiochecks also reserves the right to modify these Terms at any time. Modified Terms will be posted on this page with an updated date. Your continued use of the app after modified Terms are posted constitutes your acceptance of the modified Terms.

17. Emergency Situations

This app is not designed for and must not be used in emergency situations. If you or anyone else is experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use this app in place of emergency medical services.

18. Age Requirement

You must be at least 18 years of age to use this app. By using this app you represent and warrant that you are at least 18 years old. If you are under 18 you must not use this app. If mybiochecks discovers that a user is under 18, that user's account will be immediately terminated and all associated data will be deleted.

19. Geographic Restrictions

This app is operated from the United States. mybiochecks makes no representation that the app is appropriate or available for use in locations outside the United States. If you access the app from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

20. Force Majeure

mybiochecks is not liable for any failure to perform its obligations where such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, power failure, internet outage, or failure of third-party service providers.

21. No Waiver

The failure of mybiochecks to enforce any provision of these Terms at any time does not constitute a waiver of that provision or of any other provision. Any waiver by mybiochecks must be in writing to be effective.

22. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. You irrevocably consent to the exclusive jurisdiction of the state and federal courts located in Texas for resolution of any dispute arising out of or relating to these Terms or your use of the app. You waive any objection to the laying of venue of any such proceeding in Texas.

23. Dispute Resolution

Before filing any legal claim against mybiochecks, you agree to contact mybiochecks at support@mybiochecks.com and attempt to resolve the dispute informally for a period of at least 30 days. If the dispute cannot be resolved informally, it will be resolved through binding arbitration in Texas under the rules of the American Arbitration Association, except that either party may bring claims in small claims court if the claims qualify. You waive the right to participate in any class action lawsuit or class-wide arbitration against mybiochecks.

24. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it will be severed from these Terms. The remaining provisions will continue in full force and effect.

25. Entire Agreement

These Terms of Service and the Privacy Policy below constitute the entire and complete agreement between you and mybiochecks regarding your use of this app. They supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to this app.

1. Parties

This Privacy Policy is between you, the user of mybiochecks.com, and mybiochecks, the owner and operator of mybiochecks.com. By using this app you agree to the collection and use of your data as described in this policy.

2. What Data We Collect

Account data: Your name, email address, and account creation date. If you sign in with Google, we receive your name and email address from Google.

Health and biometric data: The biometric values you manually type into the app, including cholesterol, HDL, LDL, triglycerides, A1C, glucose, blood pressure, and BMI. The age and biological sex you enter if you choose to provide them. The date of each screening you enter. Whether you were fasting or non-fasting at the time of screening.

Usage data: Anonymous, aggregated data about how features of the app are used. This data cannot be linked to any individual user.

Technical data: Your IP address, browser type, device type, and operating system, collected automatically by our hosting provider Netlify for security and performance purposes.

We do not collect payment information. We do not collect government identification numbers. We do not collect location data beyond country or region level.

3. How We Use Your Data

We use your data for the following purposes only:

• To authenticate your identity and allow you to log in
• To store and display your biometric entries and history
• To send your biometric values to the Anthropic AI system to generate educational explanations and chat responses
• To display trend data based on your historical entries
• To improve the functionality of the app based on anonymous usage patterns
• To respond to support requests you send to us
• To comply with applicable legal obligations

We do not use your data for any purpose not listed above.

4. What We Will Never Do With Your Data

We will never do any of the following, under any circumstances:

• Sell your personal data to any person, company, or organization
• Rent or lease your personal data to any third party
• Share your personal health data with insurance companies
• Share your personal health data with employers or potential employers
• Share your personal health data with pharmaceutical companies
• Use your health data to target you with advertisements of any kind
• Share your personal data with data brokers
• Use your data for any purpose you have not been informed of in this policy

5. Who Receives Your Data

Google Firebase: Your account credentials and biometric data are stored in Google Firebase. Firebase encrypts your data and Firebase security rules restrict access so that only your authenticated account can read or write your data. Google's Privacy Policy applies to Firebase's handling of your data.

Anthropic: When you analyze results or use the AI chat feature, your biometric values are transmitted to Anthropic's API servers to generate a response. Anthropic's Privacy Policy applies to this transmission. We do not send your name or email address to Anthropic.

Netlify: This app is hosted on Netlify's servers. Netlify has access to server-level technical data as part of hosting the app. Netlify's Privacy Policy applies.

No other parties receive your data. If this changes, this policy will be updated and you will be notified.

6. Data Security

We implement the following security measures to protect your data:

• AES-256 encryption for data stored in Firebase
• TLS encryption for all data transmitted between your device and our servers
• Firebase security rules configured so that only your authenticated account can access your data
• No administrative access to individual user health data by mybiochecks personnel

Despite these measures, no method of data storage or transmission over the internet is completely secure. We cannot guarantee that your data will never be accessed by unauthorized parties. By using this app you accept this inherent risk.

7. Data Transmission to AI Systems

When you use the analyze or AI chat features of this app, your biometric data is transmitted over the internet to Anthropic's servers. This transmission is encrypted. However, you must understand that by using these features you are sending your health data to a third-party AI provider. If you are not comfortable with this, do not use the AI features of this app.

8. Your Rights Over Your Data

You have the following rights at any time:

• The right to request a copy of all personal data we hold about you
• The right to correct any inaccurate personal data we hold about you
• The right to request permanent deletion of your account and all associated data
• The right to withdraw consent and stop using the app at any time
• The right to object to processing of your data
• The right to data portability where technically feasible

To exercise any of these rights, contact us at support@mybiochecks.com. We will respond within 30 days. We will not charge a fee for responding to reasonable requests.

9. Data Retention

We retain your account and biometric data for as long as your account remains active. If you request account deletion, all of your personal data will be permanently and irreversibly deleted from our systems within 30 days of your verified request. After deletion your data cannot be recovered under any circumstances. Anonymous, aggregated usage data that cannot be linked to you may be retained indefinitely for analytical purposes.

10. Cookies and Tracking

This app uses authentication cookies to keep you logged in between sessions. These cookies are essential for the app to function and cannot be disabled without logging out. We do not use advertising cookies. We do not use tracking cookies to monitor your behavior across other websites. We use Google Analytics to collect anonymous, aggregated usage statistics. Google Analytics data cannot be used to identify individual users.

11. Children's Privacy

This app is strictly for users who are 18 years of age or older. We do not knowingly collect personal data from anyone under 18. If we discover that we have collected data from a user under 18, we will immediately and permanently delete that account and all associated data. If you believe someone under 18 has created an account, contact us at support@mybiochecks.com immediately.

12. HIPAA Notice

mybiochecks.com is not a HIPAA-covered entity and does not operate as a HIPAA business associate. This app does not provide HIPAA-compliant services. The biometric data you store in this app is not protected under HIPAA. Do not use this app if you require HIPAA-compliant handling of your health information.

13. Legal Disclosure

We will disclose your personal data if required to do so by law, court order, or valid legal process. We will disclose your data if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of mybiochecks, our users, or the public. We will make reasonable efforts to notify you before disclosing your data if legally permitted to do so.

14. Business Transfer

If mybiochecks is sold, merged, or transferred to another entity, your data may be transferred to the new owner as part of that transaction. If this occurs, we will notify you by email or by posting a notice on this page. The new owner will be required to honor the commitments made in this Privacy Policy.

15. International Users

This app is operated from the United States. If you are accessing this app from outside the United States, your data will be transferred to and processed in the United States. By using this app you consent to this transfer. The data protection laws in the United States may differ from those in your country.
